Terms of Service

1.Service Description

HeatMap Finance is a visual ETF and stock market analysis platform that provides interactive heatmaps, screeners, portfolio tracking, and analytical tools for exchange-traded funds and equities listed on US and Canadian markets.

The Service includes both free and paid tiers. Certain features, data access levels, and API usage may be restricted to paid subscribers.

2.Account Terms

You must be at least 18 years of age to create an account and use the Service.

You must provide a valid email address during registration. You are responsible for maintaining the accuracy of your account information.

You are solely responsible for safeguarding your password and for all activity that occurs under your account. You must notify us immediately at support@heatmapfinance.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for more than 12 consecutive months.

3.Subscription & Payment

Paid subscriptions are processed securely via Stripe. All prices are listed in US Dollars (USD) unless otherwise indicated.

Subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless you cancel before the renewal date. You may cancel at any time from your account settings.

Price changes will be communicated at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.Refund Policy

Monthly plans are eligible for a full refund within 7 days of the initial charge or any renewal charge.

Annual plans are eligible for a full refund within 14 days of the initial charge or any renewal charge.

After the applicable refund window, we will issue a prorated refund for the unused portion of the current billing period upon request. Refund requests should be sent to support@heatmapfinance.com.

5.Acceptable Use

You agree not to scrape, crawl, or programmatically extract data from the Service outside of the provided API.

API access is subject to rate limits as described in the API documentation. Automated access that exceeds published limits may result in throttling or suspension.

You may not redistribute, resell, or sublicense any data, visualizations, or content obtained from the Service without prior written consent.

You may not use the Service for any unlawful purpose or in any manner that could damage, disable, or impair the Service.

6.Data & Privacy

Your use of the Service is also governed by our Privacy Policy, available at /privacy. Please review it carefully to understand how we collect, use, and protect your information.

7.Intellectual Property

All content, visualizations, algorithms, designs, trademarks, and software comprising the Service are the property of HeatMap Finance or its licensors and are protected by applicable intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes unless a commercial license is separately agreed upon.

8.Disclaimer

HeatMap Finance is not a registered investment advisor, broker-dealer, or financial planner. Nothing on this platform constitutes financial advice, investment advice, trading advice, or any other sort of advice.

All data, analytics, and visualizations are provided for informational and educational purposes only. You should not make any investment decision based solely on information obtained from this Service.

HeatMap Finance is not responsible for any investment decisions you make. Past performance of any ETF, stock, or market sector does not guarantee future results. Investing involves risk, including the potential loss of principal.

8a.Atlas AI Tool

Educational tool. Atlas is an AI-powered educational assistant integrated into the Service. It is not a registered investment advisor, broker-dealer, or financial planner under any jurisdiction's securities laws (including but not limited to the US Investment Advisers Act of 1940, Canadian National Instrument 31-103, and any applicable provincial or state regulations).

AI accuracy. Atlas uses third-party large language models (currently provided by Anthropic, PBC). LLMs can produce inaccurate, outdated, or fabricated information. You agree to independently verify any factual claim, price, return figure, or recommendation surfaced by Atlas before acting on it.

No advice. Nothing Atlas says, including responses to questions like "should I buy", "is this a good investment", or "how should I allocate", constitutes financial, investment, tax, accounting, or legal advice. For decisions of consequence, you must consult a licenced human advisor in your jurisdiction.

Third-party processing. When you send a message to Atlas, the message text plus relevant context (your portfolio holdings if you have linked them, watchlist tickers, recently viewed tickers, and the current page context) is transmitted to our AI provider for processing. Our agreements with the provider govern training and retention; see our Privacy Policy for what we send, retention windows, and your rights.

No liability for AI output. To the maximum extent permitted by applicable law, HeatMap Finance is not responsible for any loss, claim, damage, or regulatory consequence arising from your reliance on Atlas's output. Section 9 (Limitation of Liability) applies in full to any Atlas-related claim.

Acceptance. On first use of Atlas you are presented with an in-product disclaimer which you must explicitly accept. Your acceptance is recorded with a version stamp; we may re-prompt you when these terms materially change. Continued use of Atlas after acceptance constitutes ongoing acceptance of these terms.

9.Limitation of Liability

To the maximum extent permitted by applicable law, HeatMap Finance and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10.Changes to Terms

We may update these Terms from time to time. When we make material changes, we will provide at least 30 days notice via email or a prominent notice within the Service before the changes take effect.

Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree, you should discontinue use and cancel your account.

11.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.
